Bus Éireann BÉClub Loyalty Programme Terms and Conditions

  1. These terms and conditions are applicable to members (the "Member") of the Bus Éireann - Irish Bus (" Bus Éireann") BÉClub loyalty programme operated by Bus Éireann (the "BEClub Loyalty Programme ") and shall be known as the "BÉClub Terms and Conditions".
  2. The BÉClub Loyalty Programme is a loyalty programme where Members earn points when they purchase Bus Éireann tickets on-line at buseireann.ie.
  3. For every €1 spent on Bus Éireann tickets on-line at buseireann.ie, Members earn 10 points, for every €10 spent Members earn 100 points, etc.
  4. Members' points are accumulated and can be redeemed by Members (once they reach the specified required levels) against a range of third party offers exclusive to the BÉClub Loyalty Programme or against the future purchase of some Bus Éireann tickets.
  5. Bus Éireann reserves the right to vary the redemption value of accumulated points at any time with or without prior notice to Members.
  6. The BÉClub Loyalty Programme commences on the 14th July 2011. Bus Éireann reserves the right to terminate the BÉClub Loyalty Programme at any time with or without prior notice to Members.
  7. The BÉClub Loyalty Programme Student Online Area commences on the 23 August 2011. Bus Éireann reserves the right to terminate the BÉClub Loyalty Programme at any time with or without prior notice to Members.
  8. The BÉClub (non-Student) Loyalty Programme Online Area is open to all persons above the age of 18 who successfully register on buseireann.ie to become a Member. Bus Éireann reserves the right to extend the categories of person to which this prohibition applies during the course of the BÉClub Loyalty Programme.
  9. Persons who possess a current valid Student Identification Card & Identification number may register as a Student in the BÉClub. On registration Student Members will be asked to confirm their College of attendance and their year of study.   10. Those Members who successfully register as BÉClub Student Members can avail of a different set of Third Party and Bus Éireann rewards/offers/discounts than non-Student Members.
  11. Student BÉClub members will not be able to avail of the offers and rewards available within the non-Student BÉClub Loyalty Programme, unless stated otherwise in the Student Online Loyalty Area.  
  12. Non-Student members will not be able to avail of the offers and rewards available within the Student Online Loyalty Area.
  13. By registering with the BÉClub Loyalty Programme Members agree to be bound by these BÉClub Terms and Conditions as may be amended from time to time by Bus Éireann. No purchase of any product is necessary to register with the BÉClub Loyalty Programme. Applicants may register on the Bus Éireann website free of charge.
  14. Only one registration to the BÉClub Loyalty Programme is to be made per person / email address.
  15. Bus Éireann may refuse any Member offers or rewards where there is evidence of abuse or attempted abuse of the BÉClub Loyalty Programme. For the avoidance of doubt abuse in this clause includes, but is not limited to:
    1. holding a BÉClub Loyalty Programme accounts in a fictitious name;
    2. holding multiple BÉClub Loyalty Programme account;
    3. claiming points not earned from a Member's own transactions;
    4. returning a purchased ticket for a refund and retaining the BÉClub Loyalty Programme points earned from the purchase of that ticket;
    5. the breaching of these BÉClub Terms and Conditions.
  16. Incorrect or incomplete registrations will be deemed invalid and the applicant will not be registered as a Member and will not be accepted for entry into the free draws set out in the Free Draw Terms and Conditions. Bus Éireann shall not be, and shall not be deemed to be, responsible for entries lost, delayed, misdirected, damaged, or undelivered, whether due to technical difficulties affecting electronic communication or otherwise.
  17. Bus Éireann shall not be, and shall not be deemed to be, responsible for any delays or difficulties experienced during registration on www.buseireann.ie.
  18. Bus Éireann shall not be, and shall not be deemed to be, responsible for any printing or website errors.
  19. Participants who register for the BÉClub Loyalty Programme and agree to opt-in to receive communications from Bus Éireann in connection with the BÉClub Loyalty Programme via mail, email and/or SMS from time to time can unsubscribe/opt-out at any time.
  20. Bus Éireann shall use Members' registration details for the purpose of operating and administering the BÉClub Loyalty Programme only, including, for the avoidance of doubt, the operation of the free draws set out in Free Draw Terms and Conditions. Members' details will not be used for any other purpose whatsoever. Please see Bus Éireann's privacy statement at buseireann.ie for further information relating to the collection, use and disclosure of such data.
  21. Bus Éireann reserves the right to modify these BÉClub Terms and Conditions at any time without notice to Members by posting revised BÉClub Terms and Conditions on the Bus Éireann website. Any such changes or modifications shall become effective immediately upon posting. It is the Members' responsibility to periodically check for any modifications to these BÉClub Terms and Conditions.
  22. Bus Éireann reserves the right to vary, cancel, postpone or modify the BÉClub Loyalty Programme at any time and for whatever reason and/or amend or withdraw this programme in whole or in part at any time with or without prior notice or any notice to Members.
  23. Although the information and materials contained on the Bus Éireann website are based upon up-to-date information, and while Bus Éireann makes all reasonable efforts to ensure that all material on the Bus Éireann website is correct, accuracy cannot be guaranteed and Bus Éireann makes no warranties or representations as to its accuracy.
  24. Bus Éireann may at its sole discretion and at any time do any of the following, without notice and without any liability whatsoever: (i) to modify or change the Bus Éireann website, and any applicable policies or terms; and (ii) to discontinue, temporarily or permanently, the Bus Éireann website including the BÉClub Loyalty Programme, with or without prior notice or any notice to Members.
  25. All text, graphics, artwork, photographs, trade marks, sounds, music, and computer code (collectively the "Content"), including but not limited to the design, structure, expression, "look and feel" and arrangement of such Content contained on the Bus Éireann website, is owned or controlled by Bus Éireann (unless otherwise stated) and is protected by copyright and trade mark laws and various other intellectual property rights and campaign laws. Except as expressly provided in these BÉClub Terms and Conditions, no part of the Bus Éireann website and no Content may be copied, reproduced, posted, publicly displayed or distributed in any way without Bus Éireann's prior written consent.
  26. Any logos used in the BÉClub Loyalty Programme (the "Trade Marks") are the trade mark or registered trade mark of Bus Éireann. Members of the BÉClub Loyalty Programme may not use or reproduce the Trade Marks, or any variations thereof, without the prior written consent of the owners of those Trade Marks. Participants may not use the Trade Marks in any way that deliberately or inadvertently suggests the appearance or impression of a relationship with or endorsement by the owners of the Trade Marks.
  27. The Bus Éireann website shall be used for lawful purposes only. Users of the Bus Éireann website shall not post any material and/or statement on the Bus Éireann website which violates or infringes in any way the rights (including the intellectual property rights) of others, which is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane, sexist, racist, indecent or otherwise objectionable or, which encourages conduct or is conduct that would constitute a criminal offence, gives rise to civil liability or otherwise violates any applicable law. Bus Éireann reserves the right to remove any offensive language submitted on the Bus Éireann website at any time and to prohibit or restrict access to the Bus Éireann website as it sees fit.
  28. Except where prohibited by law, in no event is Bus Éireann or any third party supplier of Bus Éireann responsible for any direct, incidental, special, consequential, indirect, or punitive damages of any character, or any other losses, costs, or expenses of any kind (including legal fees, expert fees, or other disbursements) arising from the BÉClub Loyalty Programme including without limitation damages for loss of goodwill, computer failure or malfunction and all other commercial damages or losses. Bus Éireann will under no circumstance whatsoever irrespective of the cause therefore, be liable for any loss, damage or personal injury to any individual, or to their property or otherwise caused or suffered in connection with the BÉClub Loyalty Programme.
  29. Bus Éireann does not warrant that any use of or access to the Bus Éireann website will be uninterrupted by error or virus free, nor shall it have any liability for damage caused by hostile software which may infect an individual's equipment or property as a result of that individual using or browsing the Bus Éireann website.
  30. By entering the BÉClub Loyalty Programme and registering his or her name, email address and any other personal information, each Member expressly consents to the processing of his or her personal information by Bus Éireann and its agents for the purposes of the BÉClub Loyalty Programme including the operation of the BÉClub Loyalty Programme.
  31. It is the responsibility of each Member to ensure that their personal information provided to Bus Éireann is up to date.
  32. The individual acknowledges and agrees that Bus Éireann has no responsibility for the information provided by websites which may link from the Bus Éireann website ("Linked Sites"). Links to Linked Sites do not constitute an endorsement by, or association with, Bus Éireann of such Linked Sites or the content, products, advertising or other materials presented on such Linked Sites. The individual acknowledges and agrees that Bus Éireann is not and shall not be deemed to be, responsible or liable, directly or indirectly, for any damage, loss or cost caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on such Linked Sites.
  33. Bus Éireann may restrict, suspend or terminate a user, including, for the avoidance of doubt, a Member, of the Bus Éireann website from accessing the Bus Éireann website if Bus Éireann believes that such individual has breached these BÉClub Terms and Conditions at any time. Any such restriction, suspension or termination will be without prejudice to any rights, which Bus Éireann may have against the individual in respect of the individual's breach of these BÉClub Terms and Conditions.
  34. The Bus Éireann BÉClub Loyalty Programme, third party offers/rewards and these BÉClub Terms and Conditions will be governed by and construed in accordance with the laws of Ireland and the courts of Ireland have exclusive jurisdiction to hear and decide any suit, action or proceeding and to settle any disputes which may arise out of or in connection with BÉClub Loyalty Programme, third party offers/rewards and these BÉClub Terms and Conditions.

 

REDEMPTION TERMS & CONDITIONS, PART A - 3RD PARTY OFFERS (Points) (the "Redemption Terms and Conditions Part A")

  1. The Bus Éireann BÉClub Loyalty Programme is a programme where Members earn points when they purchase Bus Éireann tickets on-line at buseireann.ie.
  2. For every €1 spent on Bus Éireann tickets on-line at buseireann.ie, Members earn 10 points, for every €10 spent Members earn 100 points, etc.
  3. Member's points are accumulated and as soon as these points equal [0] or more they can be redeemed by Members against a range of third party offers exclusive to the BÉClub Loyalty Programme or against the future purchase of Bus Éireann tickets.
  4. Bus Éireann reserves the right to vary the redemption value of accumulated points at any time with or without prior notice to Members.
  5. Each eligible Member of the BÉClub Loyalty Programme can avail of a range of third party offers, which can be redeemed with points accumulated by purchasing Bus Éireann tickets on www.buseireann.ie.
  6. When choosing a specific third party offer, a Member will agree to the deduction of the requisite number of points from that Member's account.
  7. There are no cash alternatives to any of the offers.
  8. Third party offers are non transferable.
  9. Bus Éireann reserves the right at its sole discretion to alter or substitute any of the third party offers with any offer of equal or greater value for any reason and without prior notification to Members.
  10. Bus Éireann shall not be, and shall not be deemed to be, responsible for any delays or difficulties experienced in the redemption of third party offers. In the case of any difficulties participants should contact the third party directly.
  11. Bus Éireann shall not be, and shall not be deemed to be, responsible for:
    1. the delivery of third party offers;
    2. the quality of third party offers;
    3. any third party offers not redeemed by participants;
    4. the content of any of the third party websites.
  12. For those third party offers which are redeemed via downloadable vouchers, the vouchers, are valid for a period of 90 days from the date of download.
  13. For the avoidance of doubt, these Redemption Terms and Conditions Part A form part of the BÉClub Terms & Conditions and the BÉClub Terms and Conditions apply and should be read in conjunction with these Redemption Terms and Conditions Part A.

 

 

REDEMPTION TERMS & CONDITIONS, PART C - Bus Éireann TICKETS (the "Redemption Terms and Conditions Part C")

  1. The Bus Éireann BÉClub Loyalty Programme is a programme where Members earn points when they purchase Bus Éireann tickets on-line at buseireann.ie.
  2. For every €1 spent on Bus Éireann tickets on-line at www.buseireann.ie, Members earn 10 points, for every €10 spent Members earn 100 points, etc.
  3. Member's points are accumulated and as soon as these points equal or more they can be redeemed by Members against a range of third party offers exclusive to the BÉClub Loyalty Programme or against the future purchase of Bus Éireann tickets.
  4. Bus Éireann reserves the right to vary the redemption value of accumulated points at any time with or without prior notice to Members.
  5. Each eligible Member of the BÉClub Loyalty Programme can use accumulated points to purchase Bus Éireann journey tickets on www.buseireann.ie.
  6. Points accumulated through the BÉClub Loyalty Programme for use in relation to Bus Éireann tickets can only be used if the points cover the full cost of the required ticket on the Bus Éireann network and cannot be used in part payment of a ticket. For example, a customer with 1900 points (i.e. €19 worth of points) can use those points to obtain a free ticket for the return service between Galway and Dublin that would usually cost €19.
  7. Tickets issued as part of the BÉClub Loyalty Programme are non refundable, non-transferable and cannot be amended. Tickets are valid for the journey and dates indicated on the booking e-mail only.
  8. Bus Éireann reserves the right to vary from time to time the Bus Éireann tickets available to Members under the BÉClub Loyalty Programme.
  9. When purchasing a ticket through the BÉClub Loyalty Programme Members must print out the booking e-mail and present it to the bus driver when travelling. Members must present the booking confirmation e-mail otherwise the ticket cannot be issued. Members must keep the Mac number code on the booking email (the "Mac Code") confidential and Bus Éireann shall not be, or shall not be deemed to be, responsible for the failure, including the consequences thereof, of a Member to keep the Mac Code confidential.
  10. For the avoidance of doubt, these Redemption Terms and Conditions Part C form part of the BÉClub Terms & Conditions and the BÉClub Terms and Conditions apply and should be read in conjunction with these Redemption Terms and Conditions Part C.

 

BÉClub ON-CAMPUS FREE PRIZE DRAW TERMS & CONDITIONS

  1. By entering the free draw and registering with BÉClub, entrants agree to accept and be bound by all terms of these official rules and by all decisions of Bus Éireann.
  2. All entries must be submitted in the name of an individual person and the prize can only be awarded to the person whose name is on the winning entry.
  3. No purchase is necessary in order to be entered into the prize draw.
  4. Registration and successful validation of BÉClub is required in order to enter into the free draw. 
  5. Entrants must successfully confirm their details and validate their BÉClub account before 28/02/2013 to be included in the free draw.
  6. Entrants will be sent a validation email to the email address provided. In order to successfully validate BÉClub membership, registrants must complete this online validation.
  7. By entering you agree that you are willing to receive the validation email and enter into future correspondence with Bus Éireann. You may unsubscribe at any time from future communications using the unsubscribe feature supplied on every email received from Bus Éireann in accordance with the Data Protection Act 1988.
  8. The Bus Éireann BÉClub is only open to residents of the Republic of Ireland.
  9. Eligible entrants must complete the entry supplied on the day of promotional activity on selected locations.
  10. Entries received outside of these dates will not be included in the draw. Incomplete entries and entries from third party agents or bulk entries will not be eligible for the prize draw. Bus Éireann will not be responsible for any entries that are not received for any reason, by the closing date, whether lost, delayed, corrupted or otherwise, and whether or not due to any technical difficulties or malfunctions. 
  11. Employees of Bus Éireann, their agents and families are excluded from participating in the free draw.
  12. 1 winner will be chosen by random selection on 04/03/2013, and will be notified directly by email or phone within 3 days.
  13. The decision of Bus Éireann will be final and binding in all matters and no correspondence will be entered into.
  14. If the winner cannot be contacted, they will be excluded and a replacement winner will be drawn and notified.
  15. Winners will receive their prizes within 21 days and will be supplied to one address in the Republic of Ireland.
  16. The winner’s full name and county may be published on various sources at the discretion of Bus Éireann. Winners may be required to supply a photograph for publication and/or take part in further reasonable promotional activities.
  17. The free draw prize consists of: 1 x Galaxy Tablet, 1x Galaxy S3 Mini, 1x 32 LED TV, 1x Netflix 12 Month Subscription, 1 x €250 One4all Voucher, 1 x €100 Tesco Voucher, 1x €100 Just Eat Voucher, 1 x €50 Boots Voucher.
  18. The prize is non-transferable and there is no cash alternative.
  19. The prize may change at any time and is subject to availability. 
  20. Bus Éireann reserves the right at its sole discretion to alter or substitute the prize with any items of equal or greater value for any reason and without prior notification.
  21. All registrations to the Bus Éireann BÉClub, which are deemed by Bus Éireann at its sole discretion not to be in eligible accordance with these terms and conditions, may be revoked and any rewards claimed by such registrants will be automatically forfeited and must be returned to Bus Éireann.
  22. The successful winner’s details including first name, surname and county may be obtained by sending a signed handwritten request along with a stamped self addressed envelope detailing your request to the Marketing Team, Bus Éireann, Broadstone, Dublin 7, Ireland.
